Any order under a product appearing in the online store website Zookimono.com requires prior consultation of these general terms & conditions. Clicking on the icon 'I accept' means both that you buy the product and also that you accept these conditions of sale. ARTICLE 1 - Purpose

This contract determines the rights and obligations of the business and consumer through the sale of goods offered by the company Zookimono on its website.

ARTICLE 2 - Contract Documents

ARTICLE 3 - Applicable law

The parties agree that this contract is subject to French law.

 ARTICLE 4 - Characteristics of goods offered

 Zookimono presents all the essential characteristics of the goods offered via its website.
 These characteristics are supported by photographs illustrating the offer.
 The company Zookimono offers on its website to sell products with the features necessary to allow compliance with Article L 111-1 of the Consumer Code, which allows for the potential consumer to know before making final order the essential characteristics of the products he wants to buy.
 Overall, these features affect the size, weight, quantity, colors, parts of property offered.

Article 5 - Commitment

ARTICLE 6 - Price

Prices are quoted in Euro.
Shipping charges will be added to the order once placed. The charges include participation in the cost of packaging, delivery and the cost of postage (these fees are subject to change at any time after the change of current rates of La Poste).

VAT is not applicable under Article 293b of the CGI.
If delivery takes place outside the territory of the European Union, customs duties and related procedures are the sole responsibility of the consumer.
The consumer undertakes to verify the compliance of delivery in terms of country of delivery.
Zookimono reserves the right to change prices at any time, however, the products will be charged on the basis of the rates in effect at the time of order entry.

ARTICLE 7 - Order Confirmation

To ascertain the will of the consumer, Zookimono asks to confirm orders by e-mail no later than upon delivery.
This confirmation by e-mail includes a reference to the goods ordered, price, method of payment and delivery mode.

ARTICLE 8 - Proof

This confirmation will be archived by Zookimono and will be considered proof of the nature of the agreement and the date within the meaning of the law of 13/03/2000.

ARTICLE 9 - Cancellation deadline

The consumer has a period of 7 days to return, at his or her expense, the products that do not suit him or her. This period starts from the date of delivery of the consumer's order. If this deadline falls on a Saturday, Sunday or holiday, it is extended until the next business day. All returns must be requested prior to Zookimono.
Only products returned in their original packaging complete and intact and in perfect condition for resale will be refunded or exchanged. Any product that has been damaged will not be refunded or exchanged.
If the consumer exercises his cancellation period, the company Zookimono undertakes to repay the sums paid, excluding the cost of return within a maximum period of 30 days.
Consumers can also choose to exchange the product. In the case of an exchange, the return will be at the expense of the consumer.

ARTICLE 10 - Delivery

Zookimono will ship products ordered within 7 days from the day after the consumer placed his order.
If the product is unavailable, the consumer will be informed at the earliest and may cancel the order. The consumer will then have the option of requesting either a refund of amounts paid within 30 days before their payment, or exchange the product.
The products are delivered to the address specified by the consumer when ordering online and stated on the order form.


ARTICLE 11 - Complaints

All complaints must be sent to the address indicated in section 1.

In no case Zookimono not be responsible for delays, damages or losses caused by the delivery company (La Poste).

In case of non-conformity of goods delivered, the consumer must make to the company Zookimono same day delivery or later than the first business day following delivery, any claim of error of delivery and / or non- conformity of goods in kind or in quality compared to the instructions on the order form.

The exchange of a product can take place only after the allocation to the consumer of a number of exchange by the company Zookimono.


ARTICLE 12 - Payment

All the orders whatever their origin, are payable in Euros.
Payment by credit card on www.zookimono.com is handled via a secure payment system not controlled by Zookimono.
This payment security is ensured by the e-payment company PayPal.
No credit card number is ever seen by Zookimono or stored on our site.
Payment in full must be made when ordering.

Retention of Property: Under the provisions of the Act of May 12, 1980, the products remain the property of Zookimono until full payment of the amount due.
The consumer aggrees to have permissions to make payment.
As part of a payment by credit card, the payment order may be revoked in case of misuse of the card according to the agreement between the consumer and the bank.
Zookimono reserves the right to suspend any order and any delivery in case of refusal to authorize payment by credit card from the officially accredited bodies or in case of nonpayment. The company Zookimono specifically reserves the right to refuse delivery or to deliver an order from a consumer who has not fully paid or partly paid a previous order or with whom a payment dispute is ongoing.

ARTICLE 13 - personal information

The consumer acknowledges having knowledge that for smooth processing of orders and the possible establishment of an account on the site www.zookimono.com, personal data collected will be processed electronically.
As such, the information may be disclosed to the contract partners of Zookimono involved in the execution of this order.
Zookimono will never rent, sell or otherwise disclose this information to any third parties not directly involved with the execution and delivery of the order. Consumers may object to such communication in writing to the address indicated in section 1.
The consumer also has a right of access and correction with respect to any information on file with Zookimono. Zookimono has deposited a declaration with the CNIL, bearing the following number 1345558.


ARTICLE 14 - Settlement of disputes

In the event that a dispute would arise from this contract, the parties agree before any legal action to seek an amicable solution.
The parties agree that any dispute arising under this contract falls within the exclusive jurisdiction of AUCH (FRANCE).

ARTICLE 15 - Partial non-validation

If one or more provisions of these terms are held to be invalid or declared as such under any law, regulation or following a final decision of a competent court, all other provisions shall remain in full force and scope.
